Provisions of Services

As a subscriber to Link Brokers Group, Inc, you understand and agree that, subject to the terms and conditions of the Agreement, Link Brokers Group, Inc shall provide you with certain aspects of Internet access and web-site hosting services. These terms and conditions shall be governed and interpreted in accordance with the laws of the State of South Carolina, United States of America.

All services provided by Link Brokers Group, Inc may be used for lawful purposes only. Transmission or storage of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to; copy righted material, material legally judged to be threatening or obscene and material protected by trade secret or other statue. The subscriber agrees to indemnify and hold harmless Link Brokers Group, Inc from any claims resulting from the use of the service, which damages the subscriber or any other parties.

NOTE: Pornography and sex-related merchandising are prohibited on any Link Brokers Group, Inc server. Link Brokers Group, Inc will be the sole arbiter as to what constitutes a violation of this provision.

As a subscriber, you are responsible for determining whom your local Internet access provider is within your local calling area and you are responsible for any long distance charges you may incur in connecting to Link Brokers Group, Inc. Link Brokers Group, Inc will not be responsible for your phone bill for any reason.

As a subscriber, you understand that Link Brokers Group, Inc reserves the right to terminate your account at anytime, for any reason, including but not limited to, your failure to abide by the terms of this agreement or your failure to pay any fees or charges when due.

You may not use Link Brokers Group, Inc  Email Service to:

1. send unsolicited email messages (a.k.a., "Spam") to anyone without their permission;
2. send unsolicited email messages to email addresses obtained from any purchased or harvested email lists in which the recipient did not expressly request to receive your email messages;
3. send email messages that harass, embarrass, defame, abuse, threaten, are libelous or slanderous, or otherwise violate the legal rights of any individual, group, or organization;
4. send email messages that contain or link to pornographic or sexually explicit content, racially or ethnically objectionable content, content that directly or indirectly promotes the use of any illegal substances, content that violates laws or regulations designed to protect minors, or other content deemed to be offensive or inappropriate by Link Brokers Group, Inc
5. send email that contains copyrighted material, including text, graphics (including trademarked material), software or other material protected by intellectual property law, for which you do not have authorization to reproduce, publish, or otherwise distribute;
6. send email that contains a computer virus or other code or files that could damage, harm, or otherwise disrupt the operation of anyone else's computer or storage device, or violate the privacy or security of any individual, group, or organization;
7. perform or promote illegal activities such as starting or forwarding chain letters, illegal contests or promotions, or any other activity that is illegal;
8. impersonate, use the name of (without expressed permission), or misrepresent any individual, group, or organization;
9. violate any applicable governmental laws or regulations or perform any activity that would cause Link Brokers Group, Inc to violate any law, statute or regulation.

You may not allow a third party to use your Link Brokers Group, Inc account and agree to indemnify and hold Link Brokers Group, Inc harmless from any damages or claims arising from such use by any third party.

You must include subscribe/unsubscribe information provided by Link Brokers Group, Inc in each message you send using LBG's Email Marketing Solution. You must also honor in a timely manner all unsubscribe requests sent directly to you from those who elected not to use LBG's Email Marketing Solution's automated subscribe/unsubscribe features, regardless of how harsh or unpleasant the unsubscribe request may be.

"No Spam" and Privacy Policies

You may use LBG's Email Marketing Solution only for "opt-in" lists, lists in which the recipient has voluntarily signed up to be on your list and has not requested to be unsubscribed. Any messages sent to users who did not request to be on your lists, whether purchased or otherwise obtained without the recipients consent, will be deemed as "Spam" and may result in termination of your account without refund and legal action, including the pursuit of damages, against you for violating this "No Spam" policy. You agree to indemnify and hold Link Brokers Group, Inc harmless from any damages and claims arising from any violation of this policy. You also agree to abide by and display a Privacy Policy or link to a Privacy Policy on your list signup page. You must either 1) use the Privacy Policy provided by LBG's Email Marketing Solution or 2) use a Privacy Policy that contains the same provisions as the Privacy Policy that is provided by LBG's Email Marketing Solution. Any violation of this Privacy Policy may result in termination of your account without refund and legal action against you. You agree to indemnify and hold Link Brokers Group, Inc harmless from any damages and claims arising from any violation of this policy.

Technical Support

Technical support is offered free of charge to Link Brokers Group, Inc customers for the assistance in configuring Cold Fusion, POP services, FTP and Front Page provided by LBG and for technical support on web site connectivity, and or web sites developed by and supported by Link Brokers Group, Inc under terms posted on Link Brokers Group’s web site. Link Brokers Group, Inc assumes that you have a basic understanding of your computer; therefore Link Brokers Group, Inc will not train users in basic computer skills such as, but not limited to, deleting files or creating directories.

Billing / Cancellations

You agree to the rates posted on Link Brokers Group, Inc web site, sign up sheet or proposal and billing procedures set forth below.

• Setup fees are non-refundable.
• Statements are sent the 1^st and the 15^th business day of the month for that month’s service.
• Payments are due on or by the 15th of each month and may be termed delinquent if not paid by the 20^th day of that month.
• Link Brokers Group, Inc reserves the right to deactivate any account not paid in full by the 20th.
• Accounts cancelled by Link Brokers Group, Inc due to lack of payment can be reactivated with a $50.00 reactivation fee.
• All returned checks are subject to $25.00 processing fee.
• Early Termination requests for account cancellation by the customer requires a thirty-day notice which could result in a balance of the unpaid term determined by the service activation date on any service contract.  By use of a Link Brokers Group hosting accounts, the customer accepts the terms and conditions set forth such agreement.
• Any account cancelled by request of the customer and left in good standing may be reactivated within thirty days without incurring a set up fee.

Link Brokers Group, Inc reserves the right to change rates, procedures and otherwise modify this agreement upon thirty days notice to the customer or as published and made available via a link on the Link Brokers Group, Inc home page at www.linkbrokers.com. Use of Link Brokers Group, Inc after the effective date constitutes acceptance of the new terms and condition. All files, information and mail under the account may be preserved for sixty days from the date the subscriber’s account with Link Brokers Group,Inc is terminated, for any reason, by either Link Brokers Group, Inc or the subscriber. After sixty days, all files, information and mail under the account will be deleted.

The subscriber agrees that Link Brokers Group, Inc has the right to delete all data, files or other information stored in the subscriber’s account if the account is terminated, for any reason, by Link Brokers Group, Inc or the subscriber.

System accounts cannot be transferred or used by anyone other than the subscriber unless Link Brokers Group, Inc, have approved a written request by the customer. No more than one login session may be used at any time by the subscriber or any system account.

Accounts that have been transferred to other parties or show other activity in violation of this paragraph are subject to immediate cancellation.

The subscriber must certify that he or she is eighteen years of age.

If the subscriber requests that Link Brokers Group, Inc provide services not delineated herein any time during the thirty day notice of cancellation and thereafter, the subscriber agrees to pay Link Brokers Group, Inc’s charges for such services in effect at the time such service was rendered.

Link Brokers Group, Inc exercises no control whatsoever over the content of the information passing through Link Brokers Group, Inc.

Liability

LIMITED LIABILITY. ANY LIABILITY OF THE COMPANY, INCLUDING WITHOUT LIMITATION, ANY LIABILITY FOR DAMAGES CAUSED OR ALLEGEDLY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMMUNICATIONS LINE FAILURE, THEFT OR

DESTRUCTION OF OR UNAUTHORIZED ACCESS TO, ALTERATION OF OR USE OF RECORDS, WHETHER FOR BREACH OF CONTRACT, TORTUOUS BEHAVIOR, NEGLIGENCE OR UNDER ANY OTHER CAUSE OF ACTION, SHALL BE STRICTLY LIMITED TO THE AMOUNT PAID BY OR ON BEHALF OF THE SUBSCRIBER TO LINKBROKERS GROUP FOR THE CURRENT MONTH.

SHOULD ANY PROVISION OF THIS AGREEMENT BE HELD TO BE ILLEGAL, INVALID OR UNENFORCEABLE BY A COURT OF LAW, THE LEGALITY, VALIDITY AND ENFORCEABILITY OF THE REMAINING PROVISIONS OF THE AGREEMENT SHALL REMAIN UNAFFECTED THEREBY, UNLESS OTHERWISE STATED.
